1. Acceptance of Terms

By accessing or using SafeMarketSwap ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

SafeMarketSwap is a peer-to-peer marketplace platform that allows users to buy and sell items locally. The platform includes safety features such as Guardian Mode, Panic Button, and optional secure payment processing.

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Be at least 18 years old
Accept responsibility for all activities under your account

4. User Conduct

You agree not to:

Post false, misleading, or fraudulent listings
Harass, threaten, or intimidate other users
Use the platform for illegal activities
Circumvent safety features or security measures
Sell prohibited items (weapons, drugs, stolen goods, etc.)
Spam or send unsolicited communications

5. Transactions

SafeMarketSwap is a platform that facilitates connections between buyers and sellers. We are not a party to any transaction between users. Users are responsible for:

Verifying the condition of items before purchase
Negotiating terms directly with other users
Completing transactions safely and legally

6. Safety Features Disclaimer

IMPORTANT: Our safety features (Guardian Mode, Panic Button, Emergency Contacts) are tools to assist you, but they do not guarantee your safety. Please note:

The 911 button opens your phone dialer but does NOT automatically call emergency services
GPS coordinates are sent to your emergency contacts, NOT to 911 dispatchers
Message delivery to emergency contacts depends on network availability
Location accuracy depends on your device's GPS capabilities

Always exercise personal judgment and do not rely solely on these features for your safety. If you feel unsafe, please contact local emergency services directly.

7. Fees and Payments

Listing items on SafeMarketSwap is free. When using our optional Secure Payment feature:

A 10% commission fee is charged on successful transactions
Payments are processed securely through Stripe
Cash transactions between users are fee-free

8. Intellectual Property

The App, including its design, features, and content, is owned by Baber-Heed Enterprises. You may not copy, modify, or distribute any part of the App without permission.

9. Privacy

Your use of SafeMarketSwap is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Limitation of Liability

SafeMarketSwap and Baber-Heed Enterprises are not liable for:

Actions or conduct of other users
Quality or safety of items listed
Disputes between buyers and sellers
Loss, injury, or damages resulting from in-person meetups
Technical failures or service interruptions

11. Indemnification

You agree to indemnify and hold harmless SafeMarketSwap, Baber-Heed Enterprises, and its employees from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion.

13. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of SafeMarketSwap shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
